Terms and Conditions applicable to the MatchMe service

Preamble

These Terms and Conditions shall apply to free Matching of members for all subscribers, also referred to as the MatchMe service, organised and carried out by our members (hereinafter, “members”) and available on the Website's platform for any person who is a Member or Subscriber.

By matching yourself online with other members to find a compatible match or a soulmate, you fully accept these Terms and Conditions.

Article 1 – Definitions

Words or phrases commencing with a capital letter shall have the following meaning:

“Account” refers to the strictly personal interface accessible by and allowing Members or Subscribers to log in to the Websites to benefit from the Services they have registered or subscribed to, complete or modify their profile, and, if needed, renew or modify their Subscription.

“Core Dating Websites” refers to Websites accessible to all Members and Subscribers.

“Match me online” means, depending on the Website delivering the Service, that all members who match other Members and Subscribers are matched.

“Match me Page” refers to a page on the Websites dedicated to a specific personal matching tool and its matching activity, including a description of the matcher and their matches/members.

“Audience or matches or soulmates finding mission” refers to users, members, or subscribers on the zillove Websites who match any user or member using the matchme tool feature and who have access to the matchme Services.

“Member” refers to a user enjoying access to one of the Services of matching themself with other members on the Websites.

“User” refers to a member or subscriber who matches themselves with other members online.

“Services” means all paid-for services accessible to Members and Subscribers on the Websites.

“Specialised Websites” refers to Websites dedicated to specific categories of Members or Subscribers.

“Subscriber” refers to a user of one or more Services who has validly purchased a Subscription to one or more Services.

“Subscription” means a paid package that grants access to paid Services for a limited period, as specified in the subscription purchased by a member.

“Website” refers to any Zillove website, the Core Dating Websites and Specialised Websites, as well as the Zillove mobile applications, through which the Services, including Matchme features, are provided.

 Article 2 – Match yourself online

2.1 Conditions for being matched online.

MatchMe is one of our premium service features. With this service, we place a MatchMe tool on someone's daily matches to see if there's mutual interest before you leap. If they respond, you only need to draft your letters and demonstrate your interest. If they like you, we will introduce and guide you through. Only persons over 18, Members or Subscribers of the relevant Services, may match themselves with other Members or Subscribers.

Any Member or Subscriber who wishes to use the matchme tool must first log in to the Website's Matchme Page using their email address and confidential username and password.

Except in the event of a wrongdoing exclusively attributable to Zillove or technical failure of the Services, the Member or Subscriber will be responsible for the use of their confidential username and password or other identifiers by third parties or actions or statements made through the Member’s personal account, whether fraudulent or not, and will indemnify and hold Zillove harmless against any claims in this respect. Furthermore, Zillove is not required and does not have the technical means to verify the identities of persons who match themselves to other members in Matchme for its Services. If the Member or Subscriber has reason to believe that a person is using their username and password, or their account, in an abusive way, that Member must immediately inform Zillove using the contact details provided in article 14 below for reporting abuse.

2.2 How to match yourself with a compatible match

To match yourself with other members, free or paid, the Member or Subscriber must:

• Provide the necessary information for their matching activity on the Matchme Page

• Read these Terms and Conditions as well as any conditions specific to Matchme and fully accept them.

• Be a paying member in accordance with the conditions and price indicated in our subscription plans.

• Only paying members who subscribe to the Matcheme feature can match themselves with other members

Before matching yourself with other members, the Member or Subscriber must ensure that all displayed information matches their own.

2.3 Exposing the subscribers to the matches or members

Each poster (e.g., a member or Subscriber) conducts its matchings to attract other members' attention and responses. Placing you on another member's profile helps determine whether they are equally interested in you.

Only the Member or Subscriber enters a contract with Zillove. They must be a paying member and subscribe to this service to match themselves online.

2.4 Unlimited number of Postings

There is no limit to the number of matches a member or subscriber can carry out each day. Only your subscription to this service and, if applicable, the period determine how long you can use it, as provided on the relevant matchme Page of the Websites.

However, only one match per day is permitted, so others may also use the service on the same day, except when multiple subscriptions are made.

A Matcher should assess whether they have enough responses to continue using the service the next day.

Article 3 – MatchMe pages

You will be matched only with those who meet your search criteria, based on your selected personality traits and subscription period. Only members who pay for this service can be matched with other members.

• Using an online payment service credit card, depending on the available options on the relevant website.

The MatchMe tool is a tailored feature that matches you with a profile, effectively introducing you to that person and helping you both connect. It is therefore tailored for two. If they like you, we will teach you and guide you through. Zillove is not involved in matching you with other members. The subscribers do that themselves.

Article 4 – Matching validity and Authenticity

A Matcher must ensure that the information posted on the Match me pages is real, valid, and authentic, and that the audience is assured that the postings are not subject to the right of withdrawal.

Subsequently, the Member or Subscriber acknowledges that any matching carried out on the Website is final and in accordance with Article 5 of the Terms and Conditions.

Consequently, members do not need to respond, accept the posted match on their profiles, or contact the matcher; only those members who wish to contact the matcher or matchers may do so at their own risk and expense.  

Article 5 – Automatic connect compatible matches

5.1 Reach your potential matches who meet your search criteria

The MatchMe tool, when instructed to match, automatically matches the subscriber only with members who meet the subscriber's search criteria.

Those on Match Me’s radar who meet the search criteria will see the subscriber's profiles on the messaging platform. Matching recipients can view profiles by date, time, or display location, and they will remain visible for 24 hours.

Consequently, Zillove members do not need to respond, click on the posted profiles, or be forced to contact the matcher or matchers; only at the free will of those members who wish to make a move and are free to do so at their own risk and expenses  

5.2 Cancellation of MatchMe connection

Zillove is not involved in matching any member. Only the MatchMe tool and the matcher can select whom to match; therefore, they cannot cancel any matches made by the matcher, matchers, or the MatchMe feature.

Matchers who are members or subscribers cannot cancel automatic matching once the Match me results have been posted to recipients.

Article 6 – Conditions for matching other members

6.1 Matcher access is restricted

Once a Match is carried out, the Member or Subscriber shall have strictly limited personal access to these MatchMe results and the recipients on the platform, given the nature of how the MatchMe tool works: once a match is carried out, the result is sent to the members who met the search criteria. One of the key benefits of this service is that it identifies perfect matches for you and sparks fly. You can then review each other's profiles and proceed from there. Now Zillove is making love happen!

It is specified that access to matchme tool may be refused to any Member, Subscriber for whom the matching or Subscription conditions have not been met before the start of the relevant matching or before the given deadline to validly acceptance or whose behaviour is not suitable to the conditions of organisation of the matching or is contrary to public order, decency, health and safety conditions or appropriate behaviour for the relevant matching or is posing a risk for the decency or safety of a third party.

Moreover, the matching result may be inaccessible to persons with visual impairments or reduced vision. Zillove is not involved in organizing or matching any members and therefore cannot provide the specific assistance required for these individuals.

Finally, it is reiterated that once a member subscribes to these services, this constitutes full acceptance of these Terms and Conditions, which are displayed on the matchme pages accessible to both the recipients and the matchers.

6.2 Conditions for matching yourself with other members.

Zillove is a fun place where single people go to find dates, romantic partners, and long-term relationships. It works because our members conduct themselves with a high degree of integrity, decency, and respect.

Before responding to or contacting the matcher, the recipients must take all necessary precautions imposed by their state of health, to avoid creating liability for the matchers' arrangement and/or being deceived, scammed, or beaten off or rape to mention a few unseen, hideous, malicious.

• For your safety, receiving this match message, you feel the urge and encouragement to meet in person with the matcher. We advise that the meeting must take place in public places for the security of our members.

• If the matching service connected you and the matcher, and you want to meet the matcher in person, Participants must ensure their own safety.

• No private home meeting is permitted; only public places and hotspots are permitted

• In using this MatchMe Services, you, the matcher, promise your best to ensure the safety of the members.

6.3 Meeting must take place in public, hotspots, parks, restaurants, bars, etc

Recipients of the match results do not guarantee a response in kind; however, if a response is received, the matcher will receive a reciprocal reaction to get to know the match recipient(s).

Article 7 – Code of Conduct

The MatchMe service is a Stressless matching system. It saves time searching for the right person for you and lets you focus on potential matches that meet your search criteria. We hope that every MatchMe match is a good experience for everyone.

Consequently, all Members or Subscribers and, if applicable, their participants agree to follow our Code of Conduct:

• Be friendly

• Be yourself

• Have appropriate and constructive conversations

• Follow the instructions of the MatchMe Terms and Conditions

• Report any inappropriate behaviour to the zillove

• Respect others’ opinions and decisions.

• Treat others the way you would like to be treated - be polite, considerate, etc

• Think of your safety and that of others during the meeting

• Drink responsibly and respect your limits

• No personal attacks, name-calling, or foul language.

• No Hate Matching and Harassment,

• No Illegal content, such as intellectual infringement

• No bashing of this site on your posting, nor foul language

• No soliciting of any kind for websites, charity or petition sites, products or services, or directing people to other websites.

• No derogatory or offensive references to sex, gender, ethnicity, or sexual orientation, and no inappropriate or offensive images or YouTube videos.

• No personally identifiable information, emails, phone numbers, or URLs. This is for your protection.

• Do not be rude, lewd, or offensive

• Do not cause any hassle with your postings

• Do not provoke or harass others

• Do not resort to violence when you meet our members offline

• Do not respond harshly to rejection

The Members, Subscribers, and their recipients remain entirely responsible for complying with our Code of Conduct and the safety matching recommendations. Zillove will not be held liable for any loss or damage incurred by the Members, Subscribers, or recipients as a result of the actions, omissions, or conduct of other Subscribers or Members arising from non-compliance with the Code of Conduct.

If participants are to meet in person, the Members, Subscribers, and their participants remain entirely responsible for complying with our Code of Conduct and for following our safety recommendations for matching yourself with other members. Zillove will not be held liable in any offline meeting that result in any loss or damage incurred by the Members, Subscribers or participant as a result of the actions, omissions or conduct of other Participants or other members of the public that occur before, during or personal meeting, including, but not limited to, an incident or accident resulting from non-compliance with the Code of conduct and/or the health and safety recommendations of the place of meeting by one of the Participants or other member of the public or from a lack of vigilance or negligence of one of the Participants.

Article 8 – Exclusion from the MatchMe Service

You are matched with the right people. It's effortless because those are the matches you need to introduce yourself to. Most importantly, if they like you, we will teach you how to reach out to them safely and find love for all the right reasons.

However, the Participants must understand that any behaviour occurring during a matching process which is contrary to the Code of Conduct in article 7 above, may result in a warning and/or the exclusion of the Participant from all future MatchMe matching of other members and participation, at the sole discretion of Zillove or, if applicable, its poster and particularly in case of insobriety, risk to the physical or mental safety of the Participant or of third parties and harassment.

If a Participant is excluded from any matching process, they may not be permitted to use the MatchMe tool in the future.

The decision to issue a warning or exclude this Participant from a MatchMe may also justify a ban from participating in any features developed by Zillove or its partners.

Finally, Zillove reserves the right to notify the competent authorities if a Participant's behaviour constitutes a disturbance to public safety or order.

Article 9 – Liability

The MatchMe tool gives the user(s) the Power to choose their matches or soulmates. You decide who you like and who you don't like. If they like you, we will introduce and guide you. You can start as soon as you're ready.

You can always advertise your search for your soulmates by deploying the MatchMe service at any time you want by clicking on the MatchMe pages and paying for subscribing to this service, as well as getting started. Still, Zillove shall not be held liable for any matching ban due to force majeure, blocking you from sending Matching to him/her, or for any damage of any kind occurring during an offline meeting attributable to a Participant or a third party at the in-person meeting places.

Members organize and conduct the matching process to attract like-minded members who share their outlook on life. They are not funded or managed by Zillove. Participation in the MatchMe service is voluntary, at your own risk and expense. Furthermore, Zillove does not guarantee the volume of responses you will receive from the recipients.

Article 10 – MatchMe Trips announcement

Get connected with the right person for you.

The service allows you to view only those that match your search criteria to determine mutual interest. Its service is nonrefundable. Once you're subscribed, you can complete the use of this service.

However, to make this work faster and more effectively for you, we can only connect this service to your membership subscription period if you specifically request that we do not. In that case, your service subscription will run concurrently with your membership period.

If you have previously canceled your membership plan, using this service will reactivate it.

These Terms and Conditions do not apply to travel services advertised at offline and in-person meetings, as Zillove does not fund your matching activities for those services.

In any case, the following will apply if no agreement is reached among the matchers, recipients, meeting venue, and participants.

These services will be subject to a contract or agreement concluded directly online between a member or Subscriber and the participant to meet offline.  

Article 11 – Complaints 

The Participant should contact Zillove with any complaints as soon as possible, and at least thirty (30) days after the matching or meeting is carried out, using any means that allow for acknowledgement, using the contact details provided in article 14 below.

Article 12 – Personal data

The information matchers provide when matching with one another and participating in in-person meetings enables Zillove and, if needed, its partners to offer and run additional features.

The members, matchers, and participants’ personal data are processed in compliance with the privacy policy available on the Website.

Article 13 – Applicable law – Litigation

These Terms and Conditions are governed, interpreted, and applied in accordance with the laws of each country we operate in and are subject to the statutory rules of the Member or Subscriber’s country of residence.

In the event of a dispute, if an amicable agreement cannot be reached, the competent authorities will be the courts of the consumer’s place of residence, located in a member state of the European Economic Area or in Switzerland.

Article 14. – Who are we?

The Services provided by Zillove to the Members and Subscribers pursuant to these Terms and Conditions are offered by Zillove International Limited, a private limited company incorporated in England and Wales with registered company number 06836932 (VAT number), whose postal and registered office is at Carpenter Court 1 Maple Road Bramhall, Stockport, Cheshire, SK7 2DH.
