Preamble

These Terms and Conditions shall apply to free Matching of members for all subscribers, also referred to as broadcasting yourself online, organised and carried out by our members (hereinafter, “members”) and available on the Website's platform for any person who is a Member or Subscriber.
By broadcasting yourself online, you fully accept these Terms and Conditions.

Article 1 – Definitions

Words or phrases commencing with a capital letter shall have the following meaning:
“Account” refers to the strictly personal interface accessible by and allowing Members or Subscribers to log in to the Websites to benefit from the Services they have registered or subscribed to, complete or modify their profile, and, if needed, renew or modify their Subscription.
“Core Dating Websites” refers to Websites accessible to all Members and Subscribers.
“Broadcasting yourself online” means, depending on the Website delivering the Service, that all members who allow Members and Subscribers, and, if applicable, their free members, may promote themselves online to their audience.
“Broadcasting yourself online Page” refers to a page on the Websites dedicated to a specific image-posting activity, containing a description of the poster and allowing members to view images that trend toward the right-hand side and disappear as new ones are added.
“Audience or matches or soulmates finding refers to users, members, or subscribers on the zillove Websites who view any user or member postings and who have access to one of the Services after posting on the Websites.
“Member” refers to a user enjoying access to one of the Services of broadcasting on the Websites.
“User” refers to a member or subscriber who promotes themselves to their Audience or matches online.
“Services” refers to all services, paid or free, accessible to the Zillove Members and Subscribers provided on the Websites of the Zillove.
“Specialised Websites” refers to Websites dedicated to specific categories of Members or Subscribers.
“Subscriber” refers to a user of one or more Services who has validly purchased a Subscription to one or more Services.
“Subscription” refers to a paid package that grants access to paid Services for a limited time, as specified in the subscription purchased by a Member.
“Website” refers to any Zillove website, namely the Zillove website, the Core Dating Websites and Specialised Websites, as well as the Zillove mobile applications, through which the Services, including broadcasting, are provided.

Article 2 – Broadcasting yourself online

2.1 Conditions for broadcasting yourself.
Only persons over 18, Members or Subscribers of the relevant Services, may post a broadcast or entice members and matches to pay attention to the personalized advertising.
Any Member or Subscriber who wishes to post for the Broadcasting must first log in to the Website's broadcasting Page using their email address and confidential username and password.
Except in the event of a wrongdoing exclusively attributable to Zillove or technical failure of the Services, the Member or Subscriber will be responsible for the use of their confidential username and password or other identifiers by third parties or actions or statements made through the Member’s personal account, whether fraudulent or not, and will indemnify and hold Zillove harmless against any claims in this respect. Furthermore, Zillove is not required and does not have the technical means to verify the identity of persons posting or participating in Broadcast yourself for its Services. If the Member or Subscriber has reason to believe that a person is using their username and password, or their account, in an abusive way, that Member must immediately inform Zillove using the contact details provided in article 14 below for reporting abuse.
2.2 How to post and attract members' attention and response
To post a broadcast, free or paid, the Member or Subscriber must:
  • • Provide the necessary information for their matching activity on the Broadcast Page
  • • Read these Terms and Conditions as well as any conditions specific to certain broadcasting and fully accept them.
  • • Be a paying member in accordance with the conditions and price indicated in our subscription plans.
  • • Only paying members who subscribe to the Broadcast themselves are allowed to post a broadcast
Before posting to the broadcast, the Member or Subscriber must ensure that all displayed information matches what they posted, as it cannot be modified after this step.
2.3 Exposing the subscribers to the matches or audience(members)
Each poster (eg, a Member or Subscriber) adds their posts to draw other members' attention and responses. A click takes you to the poster's profile for contact.
Only the Member or Subscriber enters into a contract with Zillove. They must be a paying member to post a broadcast.
2.4 Unlimited number of Postings
The poster may be subject to a minimum or maximum number of Postings, based on the number of subscriptions to this service, in accordance with the information, if applicable, provided on the relevant broadcasting Page of the Websites.
Only one post is allowed per subscription, except that when multiple subscriptions are made, various broadcasts can be carried out. It's admirable that a poster may not post more than one broadcast per day, even when all members are interested in their post on the broadcasting pages.
A poster should assess whether they have enough responses to continue posting the next day. The broadcast will disappear immediately when a new broadcast is posted.

Article 3 – Broadcasting pages

The Member or Subscriber to this service can pay the broadcast price for themselves, by card, available online
  • • Using an online payment service (PayPal, Direct Debit, etc.), depending on the available options on the relevant website.
  • • Information regarding the broadcast postings will be listed on top of the main page and will disappear when a new posting is added.
Zillove is not involved in drafting any broadcasting. The subscribers do that themselves.

Article 4 – validity and Authenticity of broadcasting

A poster must ensure that the information posted on the broadcasting pages is real, valid, and authentic, and that the audience is assured that the postings are not subject to the right of withdrawal.
Subsequently, the Member or Subscriber acknowledges that any posting for broadcast on the Website is final and in accordance with Article 5 of the Terms and Conditions.
Consequently, members do not need to respond, click on the posted broadcasting to reach the poster(s), or be forced to contact the posters; only at the free will of those members who wish to contact them are free to do so at their own risk and expenses

Article 5 – Modification or Cancellation of broadcasting

5.1 Display of the broadcasting
We may display a member's or subscriber's broadcast to the audience based on date, time, or location.
The audience can view broadcasts made by date, time, or display location, with 24 hours before they disappear.
Consequently, members need not respond, click on the broadcast, or contact the posters; only those members who wish to contact them may do so at their own risk and expense.
 
5.2 Cancellation of broadcasts
Zillove is not involved in posting any broadcasting and cannot, therefore, cancel any broadcasting made by the posters.
Posters who are members or subscribers cannot cancel a posted broadcast once it has been posted.

Article 6 – Conditions for participation

6.1 Access is restricted to broadcasting
Once a broadcast is posted, the Member or Subscriber shall have strictly limited personal access to these broadcasts on the platform, given the nature of how broadcasting works: once a broadcast is added, it trends toward the right-hand wall and disappears.
It is specified that access to post broadcasting may be refused to any Member, Subscriber for whom the posting or Subscription conditions have not been met before the start of the relevant posting or before the given deadline to validly acceptance or whose behaviour is not suitable to the conditions of organisation of the broadcasting or is contrary to public order, decency, health and safety conditions or appropriate behaviour for the relevant broadcasting or is posing a risk for the decency or safety of a third party.
Moreover, Broadcasting postings may be inaccessible to persons with visual impairments or reduced vision. Zillove is not involved in organizing the broadcast posting and therefore cannot provide the specific assistance required for these persons.
Finally, it is reiterated that once a member subscribes to these services, this constitutes full acceptance of these Terms and Conditions, which are displayed on the broadcasting pages accessible to both the audience and the posters.
6.2 Conditions for broadcasting
Zillove is a fun place where single people go to find dates, romantic partners, and long-term relationships. It works because our members conduct themselves with a high degree of integrity, decency, and respect.
Before responding to or contacting the speaker, the audience must take all precautions to avoid being deceived or scammed.
  • • For your safety, all meetings of the poster must take place in public places for the security of our members.
  • • Should the members meet the poster in person, Participants must ensure their safety.
  • • No private broadcasting is permitted
  • • In organising the Services, you, the poster, promise your best to ensure the safety of the members.
6.2 Public meeting of the poster
Before accepting a Broadcasting, the Participants must ensure that they can participate and must take all necessary precautions imposed by their state of health, to avoid creating liability for themselves in the event of an incident or accident attributable to lack of vigilance on their part or to their participation in an offline meeting which is unsuitable for their state of health.
If the Participant is unable to attend the offline meeting for medical reasons, the Broadcaster should be informed immediately to avoid unnecessary costs.
  • • For your safety, all meetings of the poster in person must take place in public places for the security of our members.
  • • No private meetings are permitted.
  • • Participants must make sure that their safety is ensured
  • • Participants in these broadcasts must not accept going to a private home for the introduction
  • • In broadcasting the Services, you, the broadcaster, promise your best to ensure the safety of the Participants should your broadcasting result in a personal meeting offline.

Article 7 – Code of Conduct

We hope that every broadcast is a good experience for everyone. Consequently, all Members or Subscribers and, if applicable, their participants agree to follow our Code of Conduct:

  • • Be yourself
  • • Have appropriate and constructive conversations
  • • Follow the instructions of the broadcasting Terms and Conditions
  • • Report any inappropriate behaviour to the zillove
  • • Respect others’ opinions and decisions.
  • • Treat others the way you would like to be treated - be polite, considerate, etc
  • • Think of your safety and that of others during the meeting
  • • Drink responsibly and respect your limits
  • • No personal attacks, name-calling, or foul language.
  • • No Hate broadcasting and Harassment,
  • • No Illegal content, such as intellectual infringement
  • • No bashing of this site on your posting, nor foul language
  • • No soliciting of any kind for websites, charity or petition sites, products or services, or directing people to other websites.
  • • No derogatory or offensive references to sex, gender, ethnicity, or sexual orientation, and no inappropriate or offensive images or YouTube videos.
  • • No personally identifiable information, emails, phone numbers, or URLs. This is for your protection.
  • • Do not be rude, lewd, or offensive
  • • Do not cause any hassle with your postings
  • • Do not provoke or harass others
  • • Do not resort to violence when you meet our members offline
  • • Do not respond harshly to rejection
The Members, Subscribers, and their audience remain entirely responsible for complying with our Code of Conduct and the safety broadcast posting recommendations. Zillove will not be held liable for any loss or damage incurred by the Members, Subscribers, or audience as a result of the actions, omissions, or conduct of other Subscribers or Members arising from non-compliance with the Code of Conduct.
If participants are to meet in person, the Members, Subscribers, and their participants remain entirely responsible for complying with our Code of Conduct and the venue's health and safety recommendations for broadcasting. Zillove will not be held liable in any offline meeting that result in any loss or damage incurred by the Members, Subscribers or participant as a result of the actions, omissions or conduct of other Participants or other members of the public that occur before, during or personal meeting, including, but not limited to, an incident or accident resulting from non-compliance with the Code of conduct and/or the health and safety recommendations of the place of meeting by one of the Participants or other member of the public or from a lack of vigilance or negligence of one of the Participants.

Article 8 – Exclusion of a broadcaster

The Participants understand that any behaviour occurring during a broadcasting which is contrary to the Code of Conduct in article 7 above, may result in a warning and/or the exclusion of the Participant from all future broadcasting posting and participation, at the sole discretion of Zillove or, if applicable, its poster and particularly in case of insobriety, risk to the physical or mental safety of the Participant or of third parties and harassment.
If a Participant is excluded from any broadcast, they may not be permitted to participate in future broadcasting.
The decision to issue a warning or exclude this Participant from a broadcast may also justify a ban from participating in any features developed by Zillove or its partners.
Finally, Zillove reserves the right to notify the competent authorities if a Participant's behaviour constitutes a disturbance to public safety or order.

Article 9 – Liability

Zillove shall not be held liable for any broadcasting ban due to a force majeure or for any damage of any kind occurring during an offline meeting and attributable to a Participant or a third party at the in-person meeting.
Members organize and post broadcasts to attract matches or like-minded members, even soulmates who share their outlook on life. They are not funded or managed by Zillove. Participation in these broadcasts is voluntary, at your own risk and expense.

Article 10 – Meeting announcement

These Terms and Conditions do not apply to travel services advertised for offline and in-person meetings, as Zillove does not fund those broadcasts.
In any case, the following will apply if no agreement is reached among the broadcaster, venue owners, matches, and members.
These services will be subject to a contract or agreement concluded directly online between a member or Subscriber and the participant to meet offline.

Article 11 – Complaints

The Participant should contact Zillove with any complaints as soon as possible, and at least thirty (30) days after the broadcast is carried, using any means that allow for acknowledgement, using the contact details provided in article 14 below.

Article 12 – Personal data

The information broadcasters provide when broadcasting and participating in in-person meetings enables Zillove and, if needed, its partners to offer and run additional broadcasts.
The in-person, posters, and participants’ personal data are processed in compliance with the privacy policy available on the Website.

Article 13 – Applicable law – Litigation

These Terms and Conditions are governed, interpreted, and applied in accordance with the laws of each country we operate in and are subject to the statutory rules of the Member or Subscriber’s country of residence.
In the event of a dispute, if an amicable agreement cannot be reached, the competent authorities will be the courts of the consumer’s place of residence, located in a member state of the European Economic Area or in Switzerland.

Article 14. – Who are we?

The Services provided by Zillove to the Members and Subscribers pursuant to these Terms and Conditions are offered by Zillove International Limited, a private limited company incorporated in England and Wales with registered company number 06836932 (VAT number), whose postal and registered office is at Carpenter Court 1 Maple Road Bramhall, Stockport, Cheshire, SK7 2DH.
